RESUMO

this dissertation explores the possibility of non-human animals to fill a suit and have standing. Animals can claim their rights before the courts. This idea is not new. Although it is possible; judges and prosecutors, as well as students and judicial employees, do not have a fundamental theory to work with. The goal of this dissertation is to suggest a frame of reference from which other scholars can develop this important area of law. This discussion will provide a substantive overview of this debate and a consistent background which human and non-humans animals will be able to understand. From discussions on standing, subject of law, and personhood we can find answers to develop Brazilian Legal sytem.
