Natureza e cultura: direito ao meio ambiente equilibrado e direitos culturais diante da criação de unidades de conservação de proteção integral e domínio público habitadas por populações tradicionais

RESUMO

The objective of this thesis lies on the analysis of the legality of administrative procedures used to create conservation units in the public domain, when traditional people inhabit the location. The research evaluated in the first place the different dimensions of fundamental rights since their historical construction, and, in detail, the specialties of the fundamental right to an ecologically-balanced environment and the cultural rights. After, a wide description about the history of protected areas creation was done, including conservation units. Furthermore, after a long study of the 9.985/00 Act, the legality of administrative procedures and final creation acts of national parks, ecological stations and biological reserves was done. The conclusion is that the legality of these administrative procedures is conditioned to an assessment of whether or not any traditional population inhabits the location and, when this is the case, an additional assessment of the ecosystems carrying capacity, in order to assure compliance with (and conciliation among) articles 215, 216 and 225 of Brazils 1988 Federal Constitution. If the impact of activities carried out by traditional group is in balance with the ecosystem, then environmental protection will take the form of a conservation unit compatible with the groups ongoing presence, preferably an extractive reserve or a sustainable-development reserve, the two official categories of environmental-management units aimed precisely at conciliating protection of the natural environment with the preservation of traditional cultures. Procedures that foster both the right to an ecologically-balanced environment and the cultural rights of traditional groups are indeed assuring fundamental rights.
