RESUMO

The work inserts the analysis of the powers entrusted of making the most important juridical document of modern society, the constitution of the state, but it also demonstrates the most existing different types of norms resultant of each one of these powers known as originary and derived. In order to show the limits imposed by the first to the second of these mentioned powers, the work broaches the consequences of the establishment of the constitutional law on the top of the normative scale. However, because of the imposition of these limits, means of controlling, in order to accomplish the will of the constitution necessarily arise and, in view of this, comes to know who should play the part of guardian of the constitution, but, specially how it have been played. In this context, it shows the growing power of those who have to play this role, playing it aside of a democratic principles. After that, there is an analysis throughout the history of the Brazilian Supreme Court.
